Liability for a slow-motion collision

This case concerns the apportionment of liability of two vessels in collision. In adjudicating the matter, the court sought the assistance of the Elder Brethren as nautical assessors on expert advice as to the reasonableness of the conduct of the master in the collision. The judge also relied on reconstructions created by the Marine Accident Data Analysis Suite (MADAS) software, which provided impartial insights contradicting the masters' evidence.
