Substitution and removal of personal representatives and trustees
Substitution or removal of personal representatives and trustees (for ease, referred to here as “PRs”)1 is one of a menu of options open to a beneficiary (or co-PR) dissatisfied with the performance of someone in one of these roles, eg, because the administration is being mismanaged in some way or progress is unacceptably slow or proving excessively expensive. Substitution or removal may also be sought because of dissatisfaction with the way discretionary powers (including dispositive powers) have or are intended to be exercised, or because an exercise is impossible due to deadlock between
multiple PRs.
