Introduction

9.1 Dispute boards (DBs) originated in North America as a pre-arbitral procedure designed to avoid formal proceedings by having an independent expert (or board of experts) issue non-binding recommendations to the parties. They first entered international usage in the late 1980s and early 1990s where they were successfully used in mega-projects such as the Channel Tunnel1 and Hong Kong International Airport.2
