Anti-suit injunctions
Anti-suit injunctions
Anti-suit injunctions provide interim relief in support of dispute resolution clauses contained in contracts for the carriage of goods by sea (charterparty or a B/L) or incorporated into a B/L. Anti-suit injunctions are powerful instruments that can be issued by a court to restrain a party from commencing proceedings, thus having a strong effect on jurisdictional or arbitral proceedings. The most common anti-suit injunction given by an English court is to restrain a party from commencing proceedings in breach of a London arbitration clause or an English jurisdiction clause.
