The insurance obligation: Overview

Obligation to insure under the Road Traffic Act 1988

2.1 Under the Road Traffic Act 1988 (RTA 1988) s 143 (1)
  • (a) using a motor vehicle on a road or other public place1 or
  • (b) causing or permitting any other person to use a motor vehicle on a road or other public place

without having in force in relation to the use of the vehicle such a policy of insurance or such a security in respect of third party risks as complies with the requirements of Part VI of the RTA 1988 is a criminal offence.2
