International Construction Law Review
BOOK REVIEW - Construction Arbitration (2nd Edition)
Construction Arbitration (2nd Edition) by Global Arbitration Review1 Andrew White, Hyun Ah Park and Geary Choe2 Yulchon LLC
Newly introduced to the world in September 2017 as the first of its kind, the Global Arbitration Review’s (GAR) Guide to Construction Arbitration achieves the seemingly impossible task of skillfully compiling and navigating through an insightful compendium of hands-on expertise and knowledge that is indispensable to the practice of construction arbitration. The Guide not only offers practical information to lawyers in various practice settings, but also generally useful information to non-lawyers and even future lawyers alike.
While the Guide remains faithful to its core goal of carefully examining various aspects of construction dispute resolution, it also devotes a substantial portion of the text to fundamental issues arising out of international construction contracts. This is particularly true of Part I: International Construction Contracts, which consist of nine chapters that lay the ground work for understanding construction disputes. One of the chapters, “Introduction to the FIDIC Suite of Contracts,” has been substantially revised in the Second Edition to reflect the updated suite of contracts published by FIDIC (The International Federation of Consulting Engineers) in 2017. This Chapter, in particular, is a valuable primer on standard forms of contracts for use between employers and contractors on international construction projects. Further, a new chapter has been added to the Second Edition, building on the introductory material and specifically addressing the FIDIC 2017 Red and Yellow Book amendments. Finally, other chapters in Part I: (i) give an overview of claims and remedies contractors and employers have against one another
