Bulk cargoes and package limitationThe facts The dispute arose out of damage to a cargo of fishoil which was carried on board the vessel Aqasia pursuant to a charterparty entered into between the defendant as the disponent owner and the claimants as the shippers and the insurers on 23 August 2013.

By clause 26, the charterparty incorporated article IV of the Hague Rules. Article IV rule 5 provides that the carrier’s liability for loss or damage to or in connection with goods shall not exceed £100 “per package or unit”.
