Shopping Centres – management schemes – variation of leases – landlord’s approach and rights

Gyle Shopping Centre General Partners Ltd v Marks and Spencer Plc [2016] CSIH 19 (16 March 2016)


Readers may recall the first instance decision which we highlighted in our November 2015 edition Commercial Leases Vol 28 Issue 9 at p2116. There were two substantial anchor tenants in the centre, Marks & Spencer and ASDA. The landlord wished to reconfigure (and reduce) the car parking area in order to carry out a development to construct additional space proposed to be let to Primark.
