Claims

Notification of claims

13.1 The Institute Cargo Clauses do not contain a requirement that claims be notified promptly.1 However, the Lloyd’s Marine Policy Form (MAR 91)2 contains “for cargo insurances only” a notice requirement, which is repeated on the standard Lloyd’s forms of insurance certificates,3 and provides:

“In the event of loss or damage which may result in a claim under this Insurance, immediate notice must be given to the Lloyd’s Agent at the port or place where the loss or damage is discovered in order that he may examine the goods and issue a survey report.”
