LOSS OF REMEDIES

INTRODUCTION

41.1 Many of the remedies discussed in the preceding chapter may be lost if the claimant waives a breach of duty or breach of contract or affirms a contract after becoming aware of a breach. We discuss these issues further below. In addition, a claimant who delays too long before seeking a remedy may become time-barred and the law of limitation is discussed in Chapter 42.
