ENVIRONMENTAL CONSIDERATIONS

The link between product liability and environmental and health and safety law

8.1 Product liability arises from the use of goods. A civil or criminal liability may arise when accidental damage results from the use of goods, provided that the user has not been negligent, or has not deliberately used the goods in a manner or for a purpose for which they were not intended, and also provided the goods have not been tampered with deliberately to avoid any expenses associated with fulfilling warranty provisions, for example, or with a view to causing damage.
