Nature and Development of Liens

17.1 The legal idea of a “lien” as giving some benefit to the claimant over and above a simple legal claim for a remedy against a particular defendant is common to both civil and common law. Its application is not. The label “lien” serves often to conceal the varieties of benefit which flow from it as between and within different legal systems.
